Resolution No. 19F37-23 <br />Page 4 <br />small scale of the proposed operation, as well as th terms and condi- <br />tions associated with t}ie operation, and the evidenc that other resi- <br />dential properties located within tk.e Animas Valley ear other extrac- <br />tive operations t,ave not appeared to gave suffere a loss in their <br />market value because of t}ieir proximity to such open tions, it appears <br />t]~at such concerns over tl.e effect on property vale s of the proposed <br />operation are exaggerated and without stil~stantial asis; the actual <br />impact on property values of the proposed operat n should not be <br />significant. <br />5. Impact on Quality of Life: Existing land u~e patterns in the <br />Animas Valley from Durango north to Hermosa contain a mixture of single <br />family residential, mobile home parks, commercial, as ell as extractive <br />and related industrial activities. in the immediat vicinity of the <br />proposed sandpit is tl~e United Construction wetlands traction and fill <br />operation, as well as the Val-Air Gliderport, in adds on to residential <br />properties. Given the character of t}ie existing 1 use patterns in <br />the immediate vicinity and the nature of the prop ed operation, it <br />would appear that the land use impacts associated with the operation can <br />be substantially mitigated provided that it is condo ted in the manner <br />set forth in tl~e application in accordance witk~ thos terms and condi- <br />tions designed to mitigate such impacts. <br />6. State Agency Approval: Given the extract ve nature of the <br />proposed land use, any County approval should be exp essly conditional <br />upon tl~e Applicant receiving and maintaining, at a times, Colorado <br />Mined Land Reclamation Board approval, as well as all approvals or <br />permits from relevant state agencies. Should such ap royals or permits <br />be suspended or revoked, such action should be snf icient cause for <br />revocation or suspension of local land use approval. <br />7. Enforcement: Since any approval of the proposed sandpit <br />operation must be conditional upon the operator's c pliance with any <br />terms and conditions which this Board attaches to uch approval, in <br />order for the operation to be compatible with the surrounding area, <br />provision should be made for the enforcement of those terms and <br />conditions, incluaing the revocation or suspension of such approval <br />should it be establis},ed to the Board's satisfaction iat the operation <br />is not in compliance with any terms and conditions wh ch the County may <br />attach to such approval. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTS COMMISSIONERS OF <br />LA PLATA COUNTY, COLORADO AS FOLLOWS: <br />1. Tl.e application of Join Dillon, dba sandco of Dur go, for a change <br />in land use to allow a mineral extraction operation for re oval of sand from <br />a sand bar located on the west bank of t}ie Animas River i hereby approved, <br />sucl. approval being expressly subject to and conditioned u n the operator's <br />compliance with the following terms and conditions. <br />
