Senate Bill 95-156, C.R.S., Section 34-32.5-1 ] 5 (4) (a) THE APPLICATION IS <br />INCOMPLETE and <br />B. Pursuant to Senate Bill 95-156, C.R.S., Section 34-32.5-115 (4) (d) THE S~~ ue.ef <br />PROPOSED MINING OPERATION...IS CONTRARY TO...LOCAL PERMTTS.~ ~~~~• <br />To expand upon point A, please refer to your `Construction Material Rules and Regulations' <br />manual effective January 1996, Page 106, Construction Materials Rule 6, Section 6.4.3 (b). In <br />this b-section it is specifically required that the Plan Maps of the affected lands show the <br />"POWER AND COMMUNICATION LINES ON THE AREA OF AFFECTED LAND <br />AND WITHIN TWO HUNDRED (Z00) FEET OF ALL BOUND_ ARIES OF SUCH AREA <br />No such lines are shown on any of the maps submitted and ye power and communication lines n <br />this area do abound. <br />Referring again to the above mentioned manual, Section 6.4.7 (2) (a) and (2) (b) require that the <br />map also LOCATE TRIBUTARY WATER COURSES, WELLS, SPRINGS, STOCK <br />WATER PONDS, RESERVOHtS, AND DITCHES ON THE AFFECTED LAND AND ON <br />ADJACENT LANDS... and IDENTIFY ALL KNOWN AQUIFERS. There are, in fact, <br />several wells on the property in question one of which is reputed to be contaminated with <br />cyanide. I also understand that there is a major aquifer in this area -yet no such water source <br />appeazs on the maps. <br />Again, in Construction Materials Rule 6.2.1 (2) (b) General Requirements state that the map <br />`MUST BE PREPARED AND SIGNED BY A REGISTERED LAND SURVEYOR, G <br />PROFESSIONAL ENGINEER, OR OTHER QUALIFIED PERSON' -yet this map is <br />
