<br />EXNI6IT C - MINING PLAN <br />1. The proposed mine site of 10 acres is a part of property operator will pur• <br />chase from Weaver Ranch, Inc., under an existing Exclusive and Irrevocable <br />Option. (See attached Memorandum of Real Estate Option Agreement.) This <br />300 acres to be purchased includes a sale of the mineral owned by Weaver <br />Ranch, Inc., on Sections 7 and 17. On Sections 8 and 18, operator has lo- <br />cated, under federal law, mining claims. Thus, under federal law, operator <br />has a superior possessory right to the mineral subject to these mining <br />claims. <br />Operator chose to purchase 300 acres from Weaver Ranch, Inc „ rlther than <br />ent~:r into a surface damage agreement with Weaver Ranch, Inc. Furthermore, <br />operator has the ability to prevent or minimize the impact upon others. <br />Under this Exclusive Option Agreement, operator has been granted an easement <br />to t:he ~troperty in question which will be surveyed and recorded at the same <br />tune that operator purchases the property. Operator is also permitting <br />I.teaver Ranch, Inc., to continue to graze cattle and to permit hunting on the <br />300 acres. <br />Operator plans to commence mining as soon as possible after all necessary <br />permits have been received as specified in Paragraph 12 below. Opera [or <br />plans to immediately, upon receipt~of the permits, exercise the option and <br />survey and record the road easement. In the meantime, operator will com- <br />mcncc mining. Operator estimates a useful life of the mine of 20 years, as- <br />suming operator on a later date, estimated to be three-five years hence, ap- <br />plies for and receives an extension or modification into a 112 permit. The <br />type of mining proposed is a quarry operation of sandstone. <br />2. '1'lier~~ is no topsoil in any appreciable quantity. Any surface material which <br />can he utilized by operator will be set aside and later used to reduce the <br />slope and highwalls during reclamation. <br />3. There: is virtually no overburden on the proposed mine site. The deposit is <br />of uuiCorm quality from the surface to the bottom of the formation. <br />~~. Tlie ;.verage depth of the deposit is .approximately SO feet. <br />5. Operator' plans to use the existing roads and trails to provide access to the <br />site. 't'hey are shown on Exhibit E in GREEN. The pit or mining location is <br />outlined in 1'ELLOIJ on Exhibit E. Mining will begin on the south boundary <br />shown on the map and shall proceed to the north. All equipment utilized at <br />the mine site will be portable. No maintenance will be done at the mine <br />site. No processing plant, office or processing equipment will be used with <br />the •axception of a portable primary jaw crusher and necessary conveyors to <br />transport and stockpile the material on site.
