F0~30~; <br />(i) At lesat semi-annually, a summary report oC the <br />status and conduct of operations hereunder. to <br />include a statement of intended operations fcr <br />the next succeeding quaver. <br />(ii) Copies of drill and core logs, geologic data, <br />reports of sampling and testing of coal and coal <br />deposits, identificz.tion of drill hole locations, and <br />other factual data (exclusive of interpretation) <br />obtained by Lessee which pertain to the Leased <br />Premises. <br />9. Assignment. Assignment by Lessee of this Lease shall be subject to <br />approval by Lessor based upon the financial, technical and operational capabilities of the <br />azsignee to perform and comply with the terms hereof, but which approval shall not be <br />unreasonably withheld. Notwithstanding the restriction on azsignment as forth herein, the <br />rights of tau Ltssce shall be freely azsignable, without consent of Lessor to working <br />interest owners, provided, however, that such assignments would be effective only upon <br />receipt of written notice oC assignment by Lessor. <br />I(t, Taxes. Lessee shall pay all od mforcm or other property taxes levied and <br />assessed against the Leased Premises. Lessee shall also pay all production, excise, <br />severance and other taxes that now or hereafter may be levied and computed on the <br />amount or vat;.e of coal which is minod and sold or otherwise diseased of from the <br />Leased Premises. <br />11. Liens. Lessee shall not cause or permit :. lien or encumbrance to attac'~ <br />or remain thereon on account of any debt for materials or services furnished to Leesce <br />for operations pursuant to this Lease; provided, however, that Lessee shall not be <br />required to remove any such lien for materials or services so long az it is contesting, in <br />good faith, the ~•alidity or the amount thereof. <br />12. Indemnification. Lessee agrees to indemnify and save Lessor harmless from <br />and against any and all losses, claims, damages, and liabilities arising or charged to arise <br />as a result of operations by Lessee upon the Leased Premises or otherwise pursuant to <br />this Lease, including without limitation, injuries to persons, damage to property, liens <br />claimed or arising out of work performed or things furnished, or failure to comply, or <br />5 <br />
