Colorado Lien may use existing gates through fences <br />and may leave said gates open unless Munroe advises Colorado <br />Lien that it is necessary that gates be opened and shut for <br />passage of vehicles in order to contain livestock or cattle. <br />9. The easement and right of way shall run with the <br />land. Colorado Lien agrees to indemnify and hold Gladys T. <br />Munroe harmless from any claims or any liability to Gladys <br />T. Munroe for injury to Colorado Lien or other persons <br />claiming damage to its or their property or personal injury <br />arising out of or attributable to the maintenance or repair <br />of .the easement and right of.way undertaken by Colorado <br />.Lien. <br />10. If, during the exploratlon and mining of the property <br />and removal of the mineral,-Gypsum, by Colorado Lien. any <br />other commercially marketable mineral shall be discovered, <br />Gladys T. Munroe shall be given immediate notice of said <br />discovery which will put her in a position to negotiate and <br />enter into appropriate royalty agreements with Rocky Mountain <br />Energy Company and Colorado Lien, as may be appropriate. <br />RENEWAL <br />This easement and right-of-Way may be renewed from year <br />to year, at the option of Colorado Lien. upon the following <br />conditions: <br />1. As ]ong as Colorado Lien has mineral.r.•ights in the <br />afore-described NW 1/4 and N 'I/2.of the SW 1/4. <br />2. Colorado Lien shall give written notice of renewal <br />to Munroe on or before April '1 of each successive year and <br />shall transmit therewith to tdunroe the sum of SEVEN HUNDRED <br />AND FIFTY DOLLARS ($750.00) for each successive year after <br />- 4 - <br /> <br /> <br />
