Exhibit E -Reclamation Plan 1. The reclamation plan for The Shores includes creation of a 112 acre lake. The applicant has stated on page 21 of the application that "We are in the process of applying for a well permit and required temporary substitute supply plan to augment evaporative loss from the ponds." Therefore, until such time that the applicant can demonstrate approval of adequate water rights not only for operational needs during mining but also evaporative loss following creation of the 112 acre lake, the Division will require a either 1) a financial warranty adequate to cover the cost of backfilling the pond/lake azea to at least 2 feet above the highest groundwater elevation monitored, and a plan and commitment for monitoring the groundwater elevation near the excavation, or 2) an alternate reclamation plan (and cost) that does not involve exposed groundwater. ~~,~d~~~ ~3" Y 2.
