<br />this Permit .and has received written authorization from the <br />Director. "Prior to Commencing Injection" requirements are set <br />forth in Part II, Section C. 1. of this Permit. <br />All conditions set forth herein refer to Title 40 Parts 124, <br />144, 196, and 147 of the Code of Federal Regulations and are <br />regulations that are in effect on the date that this Permit <br />becomes effective. <br />This Permit does not include such activities as surface <br />facilities, product pipelines, surface ponds, air issues, noise, <br />etc. These issues were covered separately as part of BLM's <br />process for approving the project and establishing construction <br />and operating stipulation, for the project. <br />This Permit consists of a total of 164 pages and includes <br />all items listed in the Table of Contents. Further, it is based <br />upon representations made by the Permittee and on other <br />information contained in the administrative record. <br />This Area Permit and the authorization to construct and <br />operate are issued for the operating life of the well(s), unless <br />terminated (Part III, Section B); no reapplication shall be <br />necessary during this period, unless the Permit is terminated for <br />reasonable cause (90 CFR §~ 144.39, 144.40 and 144.41). However, <br />the Permit shall be reviewed every five (5) years, and the <br />results of the review shall be used to determine if changes in <br />the Permit are needed and commercial operations are viable. This <br />Permit shall also remain in effect upon delegation of primary <br />enforcement responsibility for Class III wells of the UIC Program <br />to the State of Colorado, unless that State has adequate <br />authority, and chooses to adopt and enforce this Permit as a <br />State Permit or reissue a new State Permit. <br />Issued this day of ~ Id U <br />This Permit shall become effective ~ ~ ~ ~ <br />-. <br />Kerrig n C.
