<br /> <br />PART I. AUTHORIZATION TO CONSTRUCT AND OPERATE <br />Pursuant to the Underground Injection Control Regulations of <br />the U. S. Environmental Protection Agency codified at Title 40 of <br />the Code of Federal Regulations, Parts 124, 149, 146, and 147, <br />American Soda, L.L.P. <br />2717 County Road 215 <br />Parachute, Colorado 81635 <br />this is to authorize construction of <br />the Final Area Permit, to construct <br />Solution Mining wells on its Yankee <br />leases, Rio Blanco County, Colorado. <br />the following three (3) Class V rule <br />subject Area Permit; <br />solution mining wells within <br />and operate Class III <br />Gulch Joint Venture sodium <br />This authorization includes <br />authorized wells within the <br />American Soda 20-2 <br />American Soda 20-3 <br />American Soda 20-14 <br />and the first twenty-five (25) wells for commercial operations <br />that are listed below: <br />20-11 20-12 21-15 21-16 28-17 20-19 <br />29-20 28-21 29-22 29-23 29-24 20-25 <br />29-26 29-27 29-28 29-29 20-30 20-31 <br />20-32 20-33 29-34 20-35 20-36 29-68 <br />20-74 <br />Each of the permitted wells shall be located within the Area <br />Permit which is defined as follows: <br />Yankee Gulch Joint Venture Leases <br />Sections 15, 16, 17, 18, 19, 20, 21, 28, and 29 <br />Township 1 South, Range 97 West <br />Rio Blanco County, Colorado <br />This authorization is for a Class III Solution Mining <br />well(s) Area Permit to extract the mineral Nahcolite (NaHCO~) by <br />use of a solution mining process with elevated temperature and <br />pressure. Prior to receiving approval to construct additional <br />wells as authorized by this Permit, the applicant must submit the <br />information required by 90 CFR § 144.33. <br />Solution mining activities (operations) shall not commence <br />until the Permittee has fulfilled all applicable conditions of <br />EPA FINAL Area Permit No. C03856-00000 <br />Page 5 of 164 <br />
