• 2.05.4 <br />4.05.9(1) Permanent impoundments <br />(a) The water impounded will be return irrigation flow which will be <br />suitable for wildlife use. The return irrigation flow should <br />also meet applicable State and Federal water quality standards <br />although no standards will apply after final bond release. <br />(b) The level of water attainable in the pond is unknown at this <br />time. The source of water for the pond is discussed above. <br />(c) Wildlife should have no problem with safety and access to the <br />impounded water. <br />(d) The issue of water rights is discussed above. <br />(e) The U. S. Soil Conservation Service Public Standard 378, "Ponds", <br />Colorado, January, 1969 provides information on the design of <br />permanent impoundments. Nearly all of the requirements of <br />Standard 378 are duplicated in DMG Rule 4.05.6 Sedimentation <br />Ponds. There are a few requirements of Standard 378 that are <br />not specifically addressed in Rule 4.05.6 as follows: <br />Foundation cutoff. A cutoff of relatively impervious material <br />shall be provided under the dam. Based on a personal <br />• conversation (3-19-96) with Larry Reschke, P.E., the mine <br />engineer at the time the dam was constructed, a foundation <br />cutoff was constructed. Mr. Reschke indicated that a dozer <br />width was excavated from the center of the dam about four feet <br />deep and then recompacted to form the cutoff. <br />Seepage control. Based on a personal conversation (3-19-96) <br />with Larry Reschke, P.E., the mine engineer at the time the dam <br />was constructed, the emergency spillway was constructed with <br />anti-seep collars. <br />(f) The pond spillway system is a combination of principle and <br />emergency spillways. However, the single open channel spillway <br />is designed to handle the 25-year precipitation event (ref. page <br />106). Standard 378, Table 4, Page 378-6, specifies the spillway <br />must handle the 25 year event. Therefore the pond spillway <br />meets the requirements of Standard 378. <br />Area 8 - Drill Hole Abandonment <br />Drill holes, not completed to aquifers will be sealed by replacing <br />cuttings or other suitable media in the hole and placing a suitable <br />plug 10 feet below the ground to support a cement plug or other media <br />approved by the Division to within 3 feet of the ground surface. <br /> <br />130 {Rev. 6-28-96) <br />
