<br />Conditions of Approval <br />Rio Blanco County, Red Wash Pit <br />iVESW' Sec. 19, T2S, R102W, 6TH P.M. <br />1. Air Oualit~^: Fugitive dust shall be controlled during excavation and crushing activities. <br />?. Cultural Resources: If during its operations ,the operator discovers any cultural <br />remains, monuments of sites, paleontological sites, or any object of antiquity subject to the <br />Antiquities Act of Archaeological Resources Protection Act of 1979 (Public La 96-95), <br />NHPA, of 1966, Ivlineral Leasin; Act of 1920, or 43 CFR, Part3, BLM will then take such <br />action as required under the acts and regulations thereunder. The operator shall follow the <br />mitigation requirements set forth concerning protection, preservation, or disposition of any <br />sites or material discovered. In cases where salvage excavation is necessary, the cost of <br />, <br />excavation shall ce bor.-.z thz ::c:.i_:, caess otherwise stated. <br />3. Soils: The area contains fragile soils on slopes greater than 35%. Surface disturbing <br />activities ~yill be allowed in these areas only after an engineered construction-reclamation <br />plan is submitted by the operator and approved by the authorized officer. The following <br />items must be addressed in the plan: 1) How soil productivity will be restored; 2) How <br />surface runoff will be treated to avoid accelerated erosion such as riling, gulling piping, <br />sand mass wasting. When preparing the site, all suitable topsoil should be stripped from <br />the surface of the location and stockpiled for reclamation once the location is abandoned. <br />When topsoil is stockpiled on slopes exceeding five percent, construct a berm or trench <br />below the stockpile. <br />4. Existine Rights Of Wav: The owners of linear right of way crossed in the process of <br />establishing this pit shall be contacted for special conditions if necessary, prior to initiating <br />surface disturbing activities. <br />5. I~;oxious-Problem Ci-'eeds: The permittee is responsible for the control and containment <br />of noxious ~•eeds and undesirable plant species associated with this permit. <br />6. Access and Transpottation: A few years ago the county, Conoco and BL1vI ~-orked out <br />a change in the Middle Red Wash road. This change was to reroute and repair the road <br />s}'stem to correct serious erosion problems. Aside from the massive soil loss from the <br />roads .tnd drainages, the erosion was exposing natural gas pipelines. This sitttation has not <br />improved. The county road exhibits environmental degradation that is totally <br />unsatisfactory to public land management. Stipulate on this gravel pit that the road <br />reloc.ttion and and repair, including reclamation of disturbed areas be completed. <br />7. Hazardous Materials: Berms shall be placed so that inadvertent oil or fuel spills will be <br />di~:er:et! .tad contained on site. <br />6 <br />
