<br />RIDER TO MINING PERMIT <br />Permit Date: August 20, 1999 <br />Permit No: M-99-058 <br />The following additional stipulations and conditions form an integral part of the foregoing <br />permit: <br />Stipulation No. Description <br />The permitted operator will not conduct any mining or reclamation activities <br />wttlun that portion of the 6.7-acre permitted area winch lies wishing the White <br />Marble #2 Placer Claim, until the items included under Condition #2 (below) are <br />complied with. The ownership of the above-mentioned portion of the permitted <br />area lying within the White Marble #2 Placer Claim is subject to change at a time <br />subsequent to the approval of this 110 permit application. However, the <br />operator's right-of-entry is not completely precluded. By virtue of specific <br />language in the present Deed of Trust held by the operator, and pertinent to this <br />placer claim, the operator may enter upon such lands for other purposes. If the <br />operator does not acquire ownership of the White Marble #2 Placer Claim, the <br />operator needs to satisfy Condition #3 (below), and not Condition #2. <br />2. At such time that the operator acquires ownership of the White Marble #2 Placer <br />Claim, and prior to conducting mining or reclamation activities thereon, the <br />operator shall provide to the Division documents which establish to the <br />satisfaction of the Division ownership of [he property, which invests in the <br />operator the right to enter the property for purposes of mining and reclamation. <br />Once this is provided to the Division and found acceptable, Condition #3 (below) <br />will not need to be satisfied. <br />If the permitted operator does not acquire ownership of the White Marble #2 <br />Placer Claim, and is therefore prevented from obtatmng the right to enter for <br />purposes of mining and reclamation on that portion of the 6.7-acre permitted area, <br />the operator shall provide written notice to the Division specifiying that the <br />operator has not acquired such ownership. Said notice shall be submitted to the <br />Divison within five working days from the time the operator fails to acquire <br />ownership.
