Timely and successful concurrent
reclamation will greatly keep overall disturbance, and therefore
the final reclamation burden minimized.
EXHIBIT O - PROOF OF MAILING NOTICE OF PERMIT APPLICATION
This exhibit, which your outdated application calls Exhibit R, asks
for proof that the application was sent to the local Soil
Conservation District, not to the SCS. We have received the
receipts of certified mail to the SCS. I have spoken to Alex
Parrott of the SCS to verify that he actually forwarded the notice
of application to the Custer County-Divide Soil Conservation
District, as our rules require. A separate mailing of notice is
not required by you at this point, but future applications must be
noticed to the local soil conservation district, not the SCS.
EXHIBIT R - PROOF OF FILING WITH COUNTY CLERK AND RECORDER
I had previously overlooked this item during my review, but it is
present in the application, and therefore this item is satisfied.
Be reminded, however, that you must place all additional materials,
modifications, and correspondence on file there for public review.
When you have submitted all responses to the items in this letter,
please place them on file at the clerk and recorder's office, and
provide us proof of that filing.
There are no further items which I feel must be addressed by you at
this point. Please provide the necessary clarifications or
information, and any map revisions, as soon as you can. The
decision date is still set for July 12, 1995. I will want to visit
the proposed site in the next month, and I will contact you to
arrange a time. You may submit your responses to this letter
either all together or in several mailings, as you wish. If Custer
County is considering another 112 permit application in the future,
please contact us for requesting an updated application form.
If you have any questions regarding this adequacy review letter,
feel free to contact me.
~~~rely,
Bob Oswald ~
Environmental Protection Specialist
cc: Frank Beebe, Abel Engineering Professionals, Inc.,
807 North Greenwood, Pueblo, CO 81003
b:\dmgcor04.95/16-19
