Mine Identification -DMG Permit No. C 82-056 <br />• MSHA ID No. -OS-03836; Issued 1983 <br />Violation ldentiPcation: C-99-003, April 12,1999 <br />Issuing Regulatory Authority: Division of Minerals & Geology <br />Brief Description of Violation: Failure to prevent violation of Federal water quality effluent limitations. <br />Failure to pass underground mine discharge requiring treatment to meet Federal effluent limitations through a <br />treatment facility before leaving [he permit area. Failure to conduct underground mining operations as <br />described in the approved probable hydrologic consequences section of the permit. <br />Date, Location and Type of Administrative Proceedings: A proposed assessment was sent to T'CC on April 29, <br />1999 and proposed civil penalty of $1,750.00. TCC requested an assessment conference on May 5, 1999 and a <br />civil penalty of $1,000.00 was proposed based on the information presented during that conference. The <br />Division sent TCC a Settlement Agreement on May 25, 1999; TCC signed and returned the agreement on June <br />I, 1999. <br />Current Status: NOV terminated on May 14,1999. <br />Actions Taken to Abate Violation: I) Repaired underground mine water conveyance systems at the Fish Creek <br />Borehole to prevent further exceedances of federal effluent limitations. 2)Submit technical revision to revise <br />PHC section of permit.
