Reg. #: 16930, 23335 <br />SILVER DOLLAR METROPOLITAN DISTRICT'S RESPONSE TO APPLICANT <br />CLEAR CREEK DISTRICT WATER PROVIDERS' MOTION TO DENY PARTY <br />STATUS AND TO STRIKE PARTICULAR OBJECTIONS, WITNESSES AND <br />EXHIBITS <br />The Silver Dollar Metropolitan District, through counsel Grimshaw & Harring, P.C., submits <br />the following as its Response to Applicant Clear Creek District Water Providers' Motion to Deny <br />Party Status and to Strike Particular Objections, Witnesses and Exhibits: <br />Y <br />1. The Applicant has challenged the party status of the Silver Dollar Metropolitan <br />District ("SDMD") on the basis that the "Silver Dollar Metropolitan District does not own the light <br />poles and related facilities on which it bases its August 22, 2005 objection." This representation is <br />not accurate. <br />2. Although the SDMD is party to the contract identified by the Applicant (and attached <br />as Exhibit 1 to its motion), the status of the contract is not as represented. <br />3. The other party to the contract referenced, the Colorado Department of Transportation <br />("COOT"), is having the contract reviewed by the Attorney's General's office and does not presently <br />
