Not less than 60 days notice prior to star of operations will be given <br />the Division to provide sufficient time for calculations and formal setting of the bond. <br />2. Prior to start of operations ail additional permits and approvals, including the <br />Fugitive Dust Permit, Suttionary Source Pollution Emissions Permit, Stormwater NPDES <br />Permit, Stormwater Management Plan Certification, attd any other requirements that may be <br />set prior to when the operation would begin, would be acquired. <br />(Note: This is similar to several of the conditions already included in Ordinance No. <br />766 from the City of Fountain. Also, the sediment control facilities required by the city <br />have already been designed and approved. These would form the foundation for the <br />NPDES permit and the Stormwater management plan.) <br />3. In the event t}te actual mine operator desired to mine the site in a fashion different <br />from the original design or include various facilities that would complement his operation, such <br />changes will be submitted and must be approved prior to mining the site in a fashion different <br />from the originally designed plan. <br />4. If the Mined Land Reclamation Board reaffirms the original approval made on <br />January 21, 1988, Fountain Colony Investment shall submit a bond in the amount of $5,000 <br />within 60 days of formal notification of the approval action.
