<br />3. Lessee agrees to pay Lessor the sum of Five Thousand <br />Dollars ($5,000.00) for the rights under this sublease, payable <br />at time of execution hereof. Lessee additionally agrees to pay <br />Lessor seventy cents ($:70) a ton for gravel actually extracted <br />under this sublease. <br />4. Lessor agrees to pay all ad valorem real property taxes <br />levied and assessed against the leased premises and Lessee shall pay <br />all other taxes incident to or connected with any improvements installed <br />on the leased premises or incident to or connected with the operations <br />of Lessee upon the leased premises, <br />5. Lessee shall not allow any camping on the leased premises <br />and shall construct berms around equipment installed by. Lessee in <br />order to conceal them from view, in accordance with the permit <br />requirements now in force and effect under the permit issued by <br />Lessee to the Lessor. <br />6. Lessee agrees that all gravel removed from the leased <br />premises shall be weighed and the weight tickets shall be submitted <br />to the Lessor on a daily basis. After receipt and approval of these <br />tickets, Lessor shall submit to the Lessee an invoice reflecting the <br />production royalty due. Such invoice shall be issued on or about <br />the first day of each month. Lessee shall make payment of said <br />invoice on or before the fifteenth (15) day of each month for the <br />materials removed in the preceeding month and for which the invoice <br />shall issue on or about the first day of each month. <br />7. Lessee agrees to permit access to the Lessor for the purpose <br />of measuring and inspecting the leased premises. <br />8. Lessor agrees throughout the term of this lease to provide <br />ingress and egress to the. Lessee to the leased premises; provided, <br />however, tkiat any access or haul road needed by Lessee, shall be <br />constructed by and at the sole expense of Lessee. <br />-2~ <br />
