Dept. of Natural Resources <br />THTS SUBLEASE made and entered into this ~ day of ~, <br />1983, by and between Elam Construction Inc. (hereinafter called <br />"Lessor") and Pitkin County, Colorado (hereinafter called "Lessee"). <br />WITNESSETH: <br />In consideration of the mutual covenants and conditions herein- <br />after set forth, Lessor has sublet, and by these presents does hereby <br />sublease unto the Lessee the land situated in Pitkin County, State <br />of Colorado; referred to, and as particularly described in Exhibit <br />"A" attached hereto, and by this reference incorporated herein and made <br />a part hereof; including, lout not limited to, the right to access <br />public utilities located upon or below the surface of such property <br />and necessarily incident to mining and development thereof; together <br />with any and all soil, sand or gravel deposits extending onto or <br />contained in such property, together with all rights-of-way easements <br />belonging to Lessor and located at or in the vicinity of said property; <br />and together with the right to crush gravel, manufacture asphalt, <br />store trucks and equipment and perform other necessary or incidental <br />activities, all of such. sub leased property and appurtenances to be <br />hereinafter referred to as th.e "Leased Premises." <br />TO HAVE AND TO HOLD the same unto said Lessee for a term of ten <br />(10) months from the effective date hereof, or December 31, 1983, whir_h- <br />ever occurs first. <br />Lessee agrees with Lessor as follows: <br />1. Lessee agrees throughout the term of this sublease that all <br />extracted materials will be used exclusively on the airport improve- <br />meats at Sardy Field, Pitkin County, Colorado, Project 14cs. 3.08.003.01 <br />and •02. ~~duv ~• <br />2. Lessee agrees that a maximum of 50,000 tons of gravel <br />will be purchased under this sublease, unless an addendum in <br />writing on behalf of the Lessor is executed. <br />
