The Army Corp of Engineers;(ACOE) has determined that the wetland that runs <br />north south near the border of Cells C-D is anon-jurisdictional wetland. ACOE <br />correspondence has been included in Attachment M-1. A 404 permit is,therefore <br />not required for this wetland. It should tie noted that Larimer County is requiring <br />' mitigation of this wetland, the details of which are included in the revised Exhibit <br />F <br />Rule 6.4.16 ExhibitP -Municipalities within Two Miles <br />,~ 40. Exhibit P has been updated to include the address for the City of. Loveland <br />Rule 6.4.19 ExhibiYS -Permanent Man-Made Structures <br />41. The miriiiig operation will occur in the area of the Platte River Power Authority <br />(PRPA) easement: The PRPA was contacted and given mine plan's.. The <br />correspondence letter and, a,signed and notarized letter from the PRPA stating <br />the operation will have no negative effect as planned has been ircluded in <br />Attachment S-1.. The recorded easement is also included in Attachment S-1. <br />Coulson has agreed to provide access to the pit by PRPA personnel and <br />., <br />equipment any time during the mining operation. Furthermore Item d of the <br />easement provides for mining of sand and gravel. There are rio provisions in the <br />easemenffor special permissions to mine sand and gravel. This easement is not <br />a platted parcel o'r Right of Way. <br />42. The City'of Loveland has responded to the attempt to secure an agreement with <br />• a letter stating ttiat,they do not sign agreements of this type. The Geotechnical <br />slope stability Exhibit has been provided that predicts that the project will have no <br />negative effect on City of Loveland Storm Drain Pipes. A storm drain pipe <br />crossing the haul road shown in the original submittal drawings was owned by <br />the applicants Lessor at the time of the application submittal. This structure is <br />now owned by ttie City of Loveland. The geotechnical analysis has been edited <br />4o include analysis of crossing this pipe with 65 ton haul trucks and is included in <br />Attachment S=1.
