<br />overburden is 1.7 feet, with a range of between 0.5 and 6.5 feet and is pictorially shown on Map 4, <br />Camilletti Milner Pit # 2 -Reclamation Plan Map. <br />Average Thickness ofReplaced Topsoil. The proposed average thickness of the replaced topsoil will <br />be a minimum of one foot as recommended by the NRCS and is pictorially shown on Map 4, <br />Camilletti Milner Pit # 2 -Reclamation Plan Map. <br />As can be observed on Map 2, Camilletti Milner Pit # 2 -Existing Conditions Map, there is an <br />electric transmission line which passes roughly in an east west orientation through the center of the <br />proposed mine azea. The Applicant has been negotiating for nearly two yeazs with Yampa Valley <br />Electric Utility, the owner of this easement. This easement was executed neazly forty years ago and <br />it is unclear as to exactly how wide this easement is. The deed mentions a forty foot wide easement <br />but the utility claims that this easement is 100 feet wide, which is not contained in the deed. We have <br />been informed by the utility that this distribution line is very near its maximum transmission <br />capability and that in the very near future they will have to either relocate or upgrade this line. As <br />can be observed on Map 3, Camilletti Milner Pit # 2 -Mine Plan Map, it will be approximately 12 <br />years before there will be any mining in the easement. It is hoped that before that time the intentions <br />of the utility will be cleaz as to their intentions on this line. It is the intention of the Applicant that <br />this issue will be resolved before that time and the Routt County SUP contains a Specific Condition <br />which requires that this issue be resolved before there is any mining within this easement. The <br />Applicant believes based on what they have been told that this line will probably be relocated prior <br />to that time and it is our ultimate intention of mining within this easement. In the event that the <br />utility has not completed their planning by that time and the easement is left it an unmined condition <br />then the mining and reclamation plan which will be employed in this area is that depicted on Map <br />4a, Camilletti Milner Pit # 2, Reclamation Plan, which shows how the area will be mined and <br />reclaimed with the electric transmission line left in place. <br />This EXHIBIT was prepared by <br />Kent A.
