<br />would not be returned to Valco upon successful completion of <br />reclamation of the Tomichi site but to Tomichi Equipment Company as <br />per the requirements of Section 34-32-118 (5) of the Act. <br />If Valco does not add all of the Tomichi Equipment Pit area to its <br />permit area, the Division currently feels it would be required to <br />retain the forfeited bond to reclaim whatever remained of the <br />Tomichi pit. Under such circumstance, Valco's bond for the area <br />added to its Ready Mix Pit permit could not be reduced. Still, if <br />Valco were to the point of reclaiming its part of the Tomichi site <br />adjacent to the excluded portion, it would be in an advantageous <br />position to offer a competitive bid in reclaiming the excluded <br />portion of the Tomichi permit area and therefore secure some <br />benefit from the forfeited bond in the actual reclamation of, what <br />the Division understands, is now Valco's own property. <br />Mr. Cooley also suggested that a meeting between Valco's <br />representatives and the Division be considered during which the <br />group might brainstorm a bit to see if there were other options <br />available. The Division is receptive to such a meeting if Valco <br />remains interested in the Tomichi site and a date and time could be' <br />agreed upon.
