BOX 837 M~chaelB.Long <br />Division Director <br />Gunnison, CO 81230 <br />RE: Tomichi Equipment Pit (Revoked Permit M-83-064) Possible <br />Addition of Revoked Site to Valco's Ready Mix Pit Permit Area. <br />Dear Mr. Gregg: <br />Following your conversation with Mr. James Cooley at the Division's <br />meeting with County officials in Montrose on June 28, 1995 in which <br />you presumably again expressed interest in the Tomichi Equipment <br />Pit, Mr. Cooley asked the Division to see what might be done to <br />facilitate Valco's adding all or part of the area of the Tomichi <br />Equipment Pit to your Ready Mix Pit permit area. The Division, not <br />having enough forfeited bond money to reclaim the entire revoked <br />site, remains interested in having responsibility for the area <br />assumed by Valco in order to ensure its eventual reclamation and is <br />willing to explore with Valco all possible means of bringing this <br />about. <br />I have discussed the issue, again, with Bruce Humphries, Minerals <br />Program Supervisor, and, while neither of us recall exactly where <br />the Division's earlier discussions with Valco ended, it seems <br />worthwhile, as a start, to put in writing what the Division feels <br />it can do, considering the limitations imposed by the Act, in <br />regard to the use of the forfeited $5,000.00 bond it currently has <br />for reclamation of the revoked site. As I am sure was indicated <br />before, the Division does not feel it can simply turn the money <br />over to Valco for Valco's use in posting the additional reclamation <br />bond necessary to add the Tomichi site to the Ready Mix Pit permit <br />area, ie. by an amendment. The Division believes it is required by <br />Section 34-32-118 (5) of the Act to use any forfeited monies to <br />reclaim lands covered by the forfeited warranty. <br />While the responsibility for reclaiming whatever part of the <br />Tomichi Equipment Pit area that might be added to the Ready Mix Pit <br />area would be Valco's, the Division does feel it can reduce the <br />amount of the financial warranty required from Valco for this <br />additional area by $5,000.00 (less 5~ administrative fee) if the <br />entire Tomichi site is involved since this money is already <br />dedicated to the reclamation of the site.
