r <br />Item 5: As agreed during a recent telephone discussion, we will <br />dig a diversio:, ditch around the top soil pile No. 2. The small <br />pile is very close to county road 335 and any run-off will be <br />directed into the ditch along the road. The same is being done <br />since inception with topsoil pile No. 1, which is also below the <br />sedimentation pond. Any run-off from that topsoil pile is <br />directed through a ditch along the mine road to a point where the <br />mine road intercepts county road 335. <br />In a separate note, you requested information regarding the run- <br />off from the dyke of the sedimentation pond. Please note, that <br />the north side of the pond is right at the permit boundary. We <br />have constructed an irrigation ditch just north (within a few <br />feet) of the base of the dyke and any run-off is being directed <br />onto the pasture immediatedly north of the dyke. <br />Item 6: The gas cylinder at the portal has been removed a few <br />years ago. <br />General: You requested some information on the name changes of <br />the project. The original operator, under whose name the first <br />permit was sought, was Storm Ring Mines, Inc. In August 1985, <br />the name of the company was officially changed to New Castle <br />Energy Company. There was no change in ownership, just a name <br />change. <br />New Castle Energy Corporation declared bankruptcy in 1990 and was <br />formerly sold to NCIG Fiancial, Inc, on April 18, 1991. All ap- <br />propriate documents to reflect the change of ownership have been <br />filed with your office.
