O'Connor <br />November 29, 1983 <br />Page 2 <br />IRI Response: <br />We regret that our lack of foresight has led to the <br />necessity of relocating the referenced topsoil stockpile. <br />Further, we are aware of the potential degradation of <br />topsoil quality that generally is associated with movement <br />of stored topsoil. We will conduct the relocation with <br />utmost care to avoid serious degradation of the topsoil. <br />The commercial mine plant, as currently envisioned, will be <br />located approximately 1 to 1.5 miles southwest of the Pilot <br />Plant. As such, we envisioned that no future relocations <br />will be required. <br />2. MLRD Comment: <br />The Division has no problems with the operator's desire to <br />use sprays or not use sprays. However, the Division <br />requests IRI to notify this office if in fact the sprays are <br />used. If sprays are used, then the operator must take the <br />necessary steps and precautions to insure the sprays do not <br />discharge the water off-site (ie.: water discharged by <br />means other than evaporation). <br />IRI Response: <br />IRI will notify MLRD if sprays will be used as suggested. <br />Also as the Division suggests, water sprays, if used, will <br />be emplaced such that all sprayed water remains within the <br />evaporation pond. <br />3. MLRD Comment: <br />The permit application text specifies the various waste <br />streams, as addressed in your correspondence of November 9, <br />1983, will be disposed of in an approved landfill to be <br />used by IRI. The reason for this request is that in the <br />unlikely event the State of Colorado must reclaim the site <br />(because IRI is unable to), the specific landfill that will <br />accommodate IR]'s various waste streams must be known. <br />IRI Response: <br />As we have discussed over the telephone, MLRD will include <br />as a permit stipulation that prior to construction IRI will <br />specify a landfill that will accommodate IRI's various waste <br />streams. IRI will comply with this stipulation. <br />
