2. During the term of this Lease, and while GJP is performing its reclamation <br /> ' obligations as set forth in this Lease, District grants GJP reasonable rights of ingress to and egress <br /> from the Property, across other property owned by the District as follows: <br /> ' A. There currently exists a paved driveway which extends southerly from the <br /> intersection of 34 Road and E-1/4 Road to District's treatment plant. GJP shall be entitled <br /> to use this driveway for access, provided, however, that before any mining occurs on the <br /> Property, GJP at its expense shall widen this road to 24 feet and pave it to that width from <br /> its beginning point at 34 Road and E-1/4 Road to the point where it intersects with the haul <br /> ' road to the pit area. <br /> B. GJP shall construct a haul road from the driveway referred to above to the pit <br /> ' area. GJP shall treat this road when it is in use by GJP to keep it as dust free as reasonably <br /> practicable. <br /> ' C. The approximate location of the driveway and of the haul road are shown on <br /> Exhibit/f, attached hereto and incorporated herein by reference. <br /> C <br /> ' 3. GJP shall proceed with due diligence to apply for a permit from Mesa County, <br /> Colorado, to use the Property for the above purposes, and, upon the granting thereof, shall proceed <br /> ' with due diligence to apply for a permit for those purposes from the Colorado Division of Minerals <br /> and Geology ("DMG"). All costs and expenses related to the permits described in this Paragraph <br /> 3 will be paid by GJP. If either of these permits shall be denied or not granted within one year from <br /> ' the execution date of this Lease (as set forth in the introductory paragraph), then this Lease shall <br /> terminate, subject to the provisions of Paragraph 16. <br /> ' 4. The term of this Lease ("Term") is for a period of fifteen (15) years, commencing on <br /> the date ("Commencement Date") which is the earlier of(a) the date the permits referred to in <br /> Paragraph 3 of this Lease, the Well Permit referred to in Paragraph IO.A.(i) of this Lease and the <br /> ' Application referred to in Paragraph 10.A.(ii) of this Lease have all been granted and, if the <br /> augmentation or replacement plan proposed in the Application referred to in Paragraph IO.A.(ii) of <br /> t this Lease relied solely on waste or return flows from the District's planned nanofiltration plant as <br /> a source of augmentation or replacement water, the nanofiltration plant has become operational; or <br /> (b) December 31, 1997. GJP shall conduct no operations on the Property of any kind prior to the <br /> Commencement Date, except as reasonably required in order to obtain the permits described in <br /> Paragraph 3, the Well Permit referred to in Paragraph I O.A.(i) of this Lease and the Application <br /> referred to in Paragraph I O.A.(ii) of this Lease. <br /> 5. GJP shall have the right to install machinery, pumps, equipment, personal property, <br /> telephone lines, electric lines and water lines on the Property associated with its operations on the <br /> ' Property under this Lease and shall remove such items from the Property at GJP's expense at the end <br /> of the Lease term or upon any other termination of this Lease.
