1 <br /> 1 <br /> B. GJP shall obtain District's prior approval of GJP's mining plan, pit area <br /> ' layout and reclamation plans in order to develop plans which will be satisfactory to District, <br /> which approval by District shall not be unreasonably withheld. GJP shall also consult with <br /> ' District in developing a reclamation plan for the Property. District agrees that any layout of <br /> the pit area must be such that it will allow GJP to economically mine sand and gravel from <br /> the Property, and that any reclamation plan developed for the Property must be economically <br /> ' feasible and generally consistent with reclamation plans adopted for other similar pits in the <br /> Mesa County area; provided that District will not be required to approve any pit or mining <br /> or reclamation plan, or to permit any operations under this Lease, which would injure or <br /> ' interfere with the District's existing or future operations on other property now or later <br /> owned by District. <br /> ' C. The term "processing" as used in this Paragraph 1 includes activities such as <br /> screening and crushing sand and gravel mined from the Property, but it does not include <br /> ' production of other materials from the Common Materials. For example, the rights granted <br /> do not include the right to place or operate a concrete plant or asphalt plant on the Property. <br /> GJP's right to stockpile sand and gravel on the Property during the term of this Lease is <br /> limited to sand and gravel produced from the Property. <br /> D. Upon termination of this Lease by expiration of the term or otherwise, GJP <br /> ' shall remove from the Property all Common Materials stockpiled on the Property, subject <br /> to subparagraph E.(i) below. <br /> ' E. GJP is granted the right to enter or remain on the Property after termination <br /> of this Lease for the following limited purposes: <br /> (i) For a period of up to sixty days in order to remove GJP's equipment <br /> used in its operation on the Property together with all Common Materials on the <br /> ' Property at the time of termination of this Lease; provided that royalties in <br /> accordance with the provisions of this Lease shall be paid upon all such Common <br /> Materials removed from the Property under this provision; and <br /> (ii) For so long as is reasonably necessary, not to exceed one year, for <br /> purposes of reclamation of the Property in accordance with Paragraph 14 of this <br /> ' Lease. <br /> F. District's authorized agents and representatives shall at all times have the <br /> ' right, at District's risk and expense, to enter any and all of the Property at any time to inspect <br /> the Property, or to investigate any operations in connection with the transportation or <br /> processing of Common Materials, or to perform any obligation of GJP under this Lease, in <br /> ' connection with District's operations on other property or for any other reasonable purpose. <br /> ' (.\wp\1698\0<0\dos\GRAVLES 4CWD 'Z- Scpiember 20. 1996 <br /> 1 <br />
