<br /> <br /> <br />(b) The comments of the Division's adequacy letter of September `" <br />30, 1983, with respect to Exhibit C, are incorporated here by reference. <br />(c) Landowner believes some of applicant's activities outside of <br />the existing 27-acre area permitted by the Board cause lands to be "affected <br />lands," including, but not limited to, drill sites and prospecting sites, which ~- <br />are marked with concrete rebars. These areas exist over a substantial part <br />of the 320-acre area, outside of the 54 acres for which application is made. <br />10. Exhibit D <br />(a) Landowner believes that topsoil storage, stockpiling or <br />mining activities are being conducted outside the area which has been <br />permitted by the Board, specifically, in proposed area 3 and at the stockpile <br />site on the plateau above areas 1 and 2. These locations are unacceptable to <br />the Landowner and he has not been consulted, nor has he agreed to these <br />stockpiling sites. <br />(b) 400,000 tons of production per year is greatly in excess of <br />the production which has occurred to date at the mine. This production ~/ <br />would be approximately an eight-fold increase over present production. <br />Would the plant area be commensurately expanded? <br />(c) O~~erator is required by terms of the 1974 lease to consult `~ <br />with Landowner as to stockpiling areas, and has not done so. <br />(d) The mine disturbed acreage given by Operator does not add `~ <br />up to the proposed 54-acre permit area. <br />(e) The comments of the Division's adequacy letter of September `~ <br />30, 1983 are incorporated here by this reference. <br />(f) The Landowner, who lives adjacent to the mine near proposed <br />area 4, hereby requests that mining be conducted, completed and reclamation / <br />commenced in other areas before mining is commenced in proposed area 4. In <br />any event, Landowner's consent to construct a new road to this area is <br />required under the 1974 lease, and will be withheld until other areas are <br />mined out. <br />4. Landowner requests notification of the schedule by which <br />each proposed area is to be mined. <br />(g) Water matters are discussed in comments to Exhit,it G. `~ <br />11. Exhibit E. <br />Ca) Landowner has repeatedly stated that the affected land is <br />comprised of cattle range land, which is low density grazing land; c:;tile <br />pasture land, which is high density grazing land; and flood irrigated hay <br />meadow. Operator has repeatedly neglected any mention of hay meadow in <br />any plan, specifically the Niwot soils area must tie reclaimed as hay meadow. <br />-2- <br />
