Long <br />Division Director <br />Salida CO 81201 <br />Re: Items of Concern, Monarch Quarry 112 Permit Application, File Number M-2000-098 ~ <br />Dear Mr. Sandell: <br />The Division reviewed your latest response to the last adequacy letter and has determined that the. <br />following issues are still unresolved: <br />The erosion control system still needs to be described and, if applicable, located on the <br />Exhibit maps. You show the location of decant pond #1 and describe the dimensions as <br />being 400' by 65' by an average depth of 4'. This should contain all the runoff from the 2- <br />yeaz 24-hour precipitation event that will report to decant pond #1. Will you need more <br />than one decant pond to collect runoff from the outslopes of the waste pile? What kind of <br />structure, or method, will you install, or have already installed, in the decant pond(s) to <br />convey any excess runoff, during upset conditions, into the adjoining stream (drop tube, <br />culvert, spillway)? What are the dimensions of the structure (eg, 18" by 20' culvert, grouted <br />and riprapped spillway, 12' by 30')? What will the freeboazd be? <br />2. I have reviewed the file several times and can not find any proof that your application was <br />published or that you notified any of the adjoining landowners. You are required to publish <br />notice in a newspaper of general circulation pursuant to requirements of Rule 1.6.2(1)(d). In <br />addition, you are required to mail or personally serve a copy of the newspaper notice to: (i) <br />all Owners of Recotd of surface and mineral rights to the affected land and, (ii) all Owners <br />of Record of surface ]ands within 200 feet of the boundary of the affected land. This would <br />include Ms. Gloria Brown, etal. You need to submit proof of notice to the Division, <br />pursuant to requirements of Rule 1.6.2(1)(g), prior to finalizing the application review. The <br />application can not be approved without the proof of notices. <br />Two of your latest maps (your Exhibit A & B; average slope slice locations and vegetation <br />area locations) show an irregular boundary on the west side of the project (something <br />different than what you proposed in your application). What does this represent? One of the <br />maps state that this is the new boundary. Are you attempting to modify your permit <br />
