' PART II <br />Page 2 <br />A. MANAGEMENT 12EQIJIREM)iNTS <br />3. Noncompliance Notification (Conlinuedl <br />b) The permittee shall report the following instances of noncompliance orally within hventy-four (24) hours from the <br />time the permittee becomes aware of the noncompliance, and shall mail to the Division a written report within five <br />5 da s after becoming aware of the noncompliance: <br />(i) Any instance of noncompliance which may endanger health or the environment regardless of the cause of <br />the incident; <br />(ii) Any unanticipated bypass; <br />(iii) Any upset or spill which causes an exceedance of any effluent lin»ta[ion in the permit; <br />(iv) Daily maximum violations for any toxic pollutants or hazardous substances limited by PART I-A of this <br />permit and specified as requiring 24 hour notification. <br />c) The permittee shall report all other instances of non-compliance which are not required to be reported within <br />24-hours at the time Discharge Monitoring Reports are subrttitted. The reports shall contain the information listzd in <br />sub-paraeraph (a) of this section. <br />4. Submission of Incorrect or Incomplete Information <br />Where the perrttittee failed to submit any relevant facts in a perndt application, or submitted incorrect information in a <br />permit application or report to the Division, the perrttittee shall promptly submit the relevant information which was not <br />submitted or any additional information needed to corect any eroneous information previously submitted. <br />~. By ass <br />a) The permittee may allow any bypass to occur which does not cause effluent limitations to be exceeded, but only if it <br />is also essential maintenance to assure efficient operation. Division notification is not requred. <br />b) A bypass .which causes zffluent limitations to be exceeded a prohibited, and the Division may take znforcemem <br />action against a permittez for such a bypass, unless: <br />i) Bypass was unavoidable to przvent loss of hfz, personal injury, or severe property damage; <br />ii) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment facilitms, retention <br />of untreated wastes, or maintenance during normal pzriods of equipment downtime. This condition is not <br />satisfied tf the permittee could have installed sdzyuute backup equipment to prevent a bypass which <br />occurrzd durine normal penods of equipment downumc or preventative maintenance; and <br />iii) The permittee submitted notices as rzquirod m "Bypass Notification", Part ILA.6. <br />6. 13voass Notification <br />It the permutee knows in advance of the need for a bypass, a nonce shall he submiued, at least ten days before the date <br />of the bypass, to the Division. The bypass shall be subject to Division approval and limitation; imposed by tha Division. <br />\'iohu ions of reymrements Imposed by the Divison will constitutz a ctolation of this permit. <br />
