• PART 11 <br />Page 1 <br />PART R <br />A. ~1ANAGEII4ENT REQUIItE~fENTS <br />1. Chanee in Discharee ' <br />The permittee shall inform the Division (Permits and Enforcement Section) in writing of any intent to construct, install, <br />or alter any process, facility, or activity that is likely to result in a new or altered discharge, either in terms of location <br />or effluent quality or quantity prior to the occurrence of the new or altered discharge, and shall famish the Division such <br />plans and specifications which the Division deems reasonably necessary to evaluate the effect on the discharge and <br />receiving stream. <br />Process modifications include, but are not limited to, the introduction of any new pollutant no[ previously identified in <br />the permit, or an}' other modtficattons which may result in a discharge of a quantity or quality different from that which <br />was evaluated in [he draftine of the permit including subsequent amendments. Following such notice, the permittee may <br />be required to submit a new or revised CDPS application and the permit may be modified to specify and limit any <br />pollutants not previously limited, if the new or altered discharge might be inconsistent with the conditions of the existing <br />permn. In no case shall the ptrmittee implement such change without first modifying the permit to reflect the change or <br />uhtaining confirmanon from the Division that no chance is required in the permit. <br />2. ~ecial NtHificatinns -Definitions <br />a) Bypass: The intentional diversion of waste streams from any portion o(a treatment facility. <br />b) Severe Property Damage: Substantial physical damage to property at the treatment facilities which causes them to <br />become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to <br />occur in the absence of a bypass. tt does no[ mean economic loss caused by delays m production. <br />c) Spill: An incident m which tlous or solid materials are accidentally or unintentionally allowed to flow ur escape so <br />as to be lost from thz treatment, processine or manufacturing system which may cause or threaten pollution of stale <br />w'alC fS. <br />d) Upset: An exceptional incident m which there is unintzntional and temporary noncompliance with permit zftluznt <br />limitations because of factors beyond thz reasonable control of the permittee. An upset does not include <br />noncompliance to the extent caused by operational error, improperly desiened treatment facilities, inadequate <br />treatment facili4es, lack of preventative maintenance, or careless or improper operation. <br />3.
