Burden of Proof Requirmients (continued) <br />Should a precipitation event or smwrelt occur, the permittee shall submit adequate proof in order <br />for en exertption to be claimed. Said proof shall be submitted as an attaclment to the Discharge <br />Monitoring Report (!MR) for the appropriate period. the Division shall determine the adequacy of <br />proof. As part of this determination, the Division shall evaluate whether the permittee could have <br />controlled the discharge in such a warner that primary limitations could have been met. All manual <br />dewatering of the ponds shall meet 1'SS and total iron limitations. <br />3. Post-Mi^ino Areas <br />Commencing at the time active ml.ning has ceased and surface areas have been recurred to the required <br />contour and revegetation has begun, all applicable discharges may be eligible for limitations other <br />than those specified in Pazts I.A.1. 'these post-mining limitations shall remain in effect until <br />bond release. 'Ihe permittee shall notify the Division Upon cessation of active mining so that <br />consideration of appropriate permit modifications can be made. <br />4, Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged frao the site, the <br />pennittee shall monitor the wastewater effluent a[ the following frequercy: <br />Outfalls Freauencv Sasmle 1Woe <br />001, 002, 003, 005, 006, 008, 009, 010, Quarterly Grab <br />011, 012, 013, 014, 015, 016 <br />S. Best Management Practices - 001. 002. 005 <br />For the pN vaziance, as listed in Part I.A.1. to be in effect, the permittee mast be taking all <br />reasonable rtw_asures to reduce the pM, including the use of a COZ bubbler at the outfall(s). <br />Documentatirnn of such shall be submitted with the applicable ClIIi any time a pH level of over 9.0 <br />s.u. is reported. <br />'Ihe pennittee may develop other appropriate measures to control pH, such as the use of appropriate <br />algicides, aquatic life, etc. However, such m+ac~~*es in addition to or instead of the ODZ bubbler <br />mist be approved by the Division via a permit amerdrient prior to their use. <br />A. MONITC)RINC REQUIRF}iQIIS <br />1. Freouencv and Samole 7Wye <br />1n order to obtain an indication of the probable compliance or noncompliance with the effluent <br />limitations specified Ln Part L.A.1, the pennittee shall monitor all effluent parameters at the <br />following frequencies. Such monitoring will begin imrediately and last for the life of the permit <br />unless othervlse noted.
