Ms. Kimberly Edwards <br />June 25, 2007 <br />Page Z <br />The lagged effects of ground water depletions were estimated using a Glover analysis and <br />the fallowing assumptions: 1) Distance from the centroid of the gravel pit to the stream was 1,700 <br />feet, 2) the transmissivity was 50,000 gpolft., 3) the specific yield was assumed to be 0.2, and 4) <br />the impermeable boundary distance was estimated to be 2,625 feet. <br />The proposed source of replacement water for depletions created by this operation is a <br />water lease agreement with Upper South Platte Water Conservancy District ("District"}. This lease <br />provides far a total of 11 acre-feet of replacement water, which is projected to be for 5 acre-feet for <br />genera( use and 6 acre-feet for road construction of Park County Road 77. The agreement was <br />dated August 30, 2006 and is valid until January 1, 2009. A monthly breakdown of the annual <br />depletions, which include 1.45 acre-feet of net evaporative loss (using an assumed ice cover <br />period of November through March) and 0.5 acre-foot of water used for dust control can be found <br />on the attached Table 1. The depletions from the operation of the Ansley Plat Pit will be replaced <br />from the 5 acre-feet of general use water leased from the District. The District currently operates <br />under an SWSP approved by the State Engineer. The District's SWSPrs currently valid until <br />October 10, 2007 and a renewal request has been submitted for 2008 and is currently pending <br />evaluation by the State Engineer's Office. <br />1 hereby approve the proposed SWSP in accordance with Section C.R.S. §37-90-137(11), <br />subject to the following conditions: <br />1. This SWSP is approved with the effective date of April 1, 2007 and shall be valid through <br />December 31, 2008 (to be consistent with the term of the District's lease agreement). If this <br />SWSP wilt not be made absolute by a water court action by the SWSP's expiration date, a <br />renewal request must !x: submitted to this office with the statutory fee (currently $257) rto later <br />than November 15, 2008. <br />2. A well permit must be issued for the gravel pit in accordance with C.R.S. § 37-90-137(2) and <br />(11}for the exposure and use of groundwater. A gravel pit well permit application (receipt no. <br />3614611) was submitted to this office on March 23, 2007 and is under review at this time. The <br />provisions of C.R.S. § 37-90-137(2) prohibit fhe issuance of a permit for a well to be located <br />within 600 feet of any existing well, unless the State Engineer finds that circumstances so <br />warrant after a hearing held in accordance with the procedural rules in 2 CCR 402-5. This <br />hearing may be waived if you are able to obtain statements from the owners of all wells within <br />600 feet, verifying that they have no objection to your use of the proposed well. Should a new <br />well permit be denied for reasons of 600 foot spacing, or any other legitimate reason, approval <br />of this SWSP will be cancelled. <br />3. The total surface area of the groundwater exposed after January 1, 1981 at the Ansley Flat PR <br />must not exceed 0.80 acres during the approval period of this SWSP and the annual <br />evaporative loss is estimated as 1.45 acre-feet (using an assumed ice cover period of <br />November through March). <br />4. The annual amount of water used for dust control at the Ansley Flat Pit shall not exceed 0.5 <br />acre-feet per year. <br />5. In the event that more than 0.5 acre-feet per year is used for dust control, or more than 0.80 <br />acres of surface area of groundwater is exposed after January 1, 1981, Applicant is required to <br />immediately file an amendment to this SWSP to include such increased amounts. <br />6. Approval of this SWSP is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />
