(b) Non-Conforming Structure, legal shall mean a building or portion thereof or <br />other structure, which lawfully existed on the effective date of these regulations, <br />but since that time the regulations have changed That would prohibit or limit the <br />construction of this structure due to current Zoning Regulations. <br />(c) Non-Conforming Use, legal shall mean a use or activity which was lawful prior <br />to the adoption, revision, or amendment of this Zoning Regulation but which fails, <br />by reason of such adoption, revision, or amendment, to conform to the present <br />requirements of this regulation. <br />(d) Nursing Home (see health care facility) <br />1.715 - O <br />(a) Occupant shall mean the person occupying, or otherwise in real or apparent <br />charge and control of, a building or lot. <br />(b) Occupied shall mean arranged, designed, built, altered, converted, rented or <br />leased or intended to be lived in. <br />(c) Oil and Gas Exploration and Production shall mean the drilling, extraction, and <br />transportation of subterranean fossil gas and petroleum, and the necessary <br />attendant uses and structures, but excluding the refining, processing, or <br />manufacturing thereof. <br />(d) Open Space shall mean an area of land unobstructed from the ground upward, <br />or water, set aside, dedicated, designated, or reserved for the recreation, scenic, <br />or leisure use of the public or owner of the property. <br />(e) Open Storage shall mean the outside accumulation or collection of materials to <br />on area not fully enclosed by a building. <br />(f) Outdoor Activity shall mean the utilization of any portion of a site where <br />commercial, industrial, recreation, or storage activities related to the principal use <br />of a site are conducted outdoors, except for customer or employee parking. <br />(g) Owner shall mean to possess property by deed or title. <br />(h) Owner-occupied shall mean lived in as the owner s primary place of residence. <br />1.716 -P <br />(a) Parking Lot shall mean an improved or unimproved, off-street parking facility <br />containing four (4) or more parking spaces. <br />(b) Parking Space shall mean a position designated for parking for one motor <br />vehicle, whether within n parking lot, garage/covered parking or adjacent a <br />residence. <br />Gilpin County Zoning Regulations 19 <br />
