RECORDING.. Ihis Agreement, any amendment hereto, and any release entered into pursuant to Section 16 above, shall be recorded by Operator, which shall provide the other parties with a copy showing the recording information as soon as practicable [hereafter. 19. SURFACE DAMAGES. !n consideration of the parties' tights and obligations, as outlined herein, this Agreement shall constitute the agreement for surface damages required pursuant to the COGCC's Rules and Regulations Surface Owners waive any claim for surface damages, including all damages provided by the Oil and Gas Lease, which smface damages are to the Oil and Gas Operations Areas and to any portion of the Property, including growing craps, buildings, irrigation ditches, feed lots, fences, etc., caused by Operator's operations within the Oil and Gas Operations Areas or upon access toads, gathering lines, pipelines or other easements used in connection with the Oi] and Gas Operations Areas the waiver of surface damages provided herein shall include any claim for excessive smface use insofar as the Oil and Gas Operations Areas is used to produce oil and gas fiom any portion of the Property or land pooled therewith.
