SETBACK REQU112EMENTS. <br />The Oil and Gas Operations Areas ate more particularly described on the attached Exhibit B. <br />Surface Owner will not locate any building or structure within the Oil and Gas Operations Areas, except <br />Surface Owner shall have [he right to stockpile materials and operate portable processing equipment <br />within the Oil and Gas Operations Areas not then occupied by Operator. Upon thirty (30) days notice <br />fiom Operator, Surface Owner shall remove all stockpiled materials and portable processing equipment <br />from within the Oil and Gas Operations Areas. Suface Owner's materials shall be stockpiled or located <br />in such a manner so as not to obstruct or impede access by Operator to its wellsite(s) and equipment <br />Additionally, Surface Owner shall be permitted [o disturb the surface and engage in gravel <br />mining operations within the Oil and Gas Operations Area in the NE/4NW/4 pursuant to the following <br />rules: <br />A. If Surface Owner commences gravel <br />Operations Area before Operator has <br />Owner's operations, Surface Owne <br />specifications; and <br />mining operations within this Oil and Gas <br />drilled any wells, upon completion of Surface <br />r shall backfill the area to Operator's <br />B If Operator drills a well(s) ixi this Oil and Gas Operations Area before Surface <br />Owner commences gravel mining operations, Surface Owner shall be permitted to <br />distwb the surface of the Oil and Gas Operations Area no closet than eighty feet (80') <br />from the well(s) for gravel mining proposes, which area shall be backfilled and leveled <br />by Surface Owner upon thirty (30) days' notice of operations from Operator <br />3. ACCESS. <br />Surface Owner shall provide to Operator all necessary non-exclusive easements for access to the <br />Oil and Gas Operations Areas. Such access for the Existing Well and Fa[ure Wells to be located in The <br />NW/4NW/4 shall be as shown on Exhibit B Access located on the Property for Future Wells to be <br />located in the NFJ4NW/4 shall be designated upon mutual agreement of the parties, which agreement <br />shall not be unreasonably withheld <br />4. BATTERIES AND EQUIPMENT. <br />Operator shall have the tight to locate, build, repair and maintain equipment reasonably <br />appropriate for the operation and production of the Existing Well and any Future Wells only within the <br />Oi! and Gas Operations Areas and Top Facilities as shown on Exhibit B. <br />With respect to Operator's equipment, facilities and general operations, Operator shall comply <br />with all Colorado Oil and Gas Conservation Commission ("COGCC") rules and regulations Any other <br />arrangements or requirements regarding operations shall be resolved by mutual agreement ofthe parties <br />5. FLOWLINES AND PD'ELINES <br />Surface Owner shall grant 25' non-exclusive easements for flowlinos to Operator and 25' non- <br />exclusive pipeline easements to Operator for any relocated or new flowlines or pipelines on the Property <br />as may be required pursuant to paragraph 6 below, and for any new flowlines or pipelines constructed on <br />
