numeric protection level(s), additional monitoring locations, if any, reporting <br />plans, including reporting frequency, and a commitment to report in writing to the <br />Division, within five working days, when there evidence that an established <br />numeric protection level has been exceeded at a point of compliance. The <br />technical revision must also contain an action plan for instances where numeric <br />protection levels are exceeded at points of compliance, such action plan to include <br />immediate resampling of the point of compliance, expedited analysis of the <br />resample, and reporting of the resample results to the Division within 24 hours of <br />the Operator's receipt of the results. If the resample substantiates that a numeric <br />protection level has been exceeded, the Operator will file with the Division, <br />within ten working days, a mitigation plan to control the release of contaminants <br />exceeding numeric protection levels to areas down-gradient ofthe compliance <br />point. The requirement to provide a mitigation plan within ten working days may <br />be accelerated if the Division determines that there is an imminent threat to <br />persons, property or the environment. <br />2. The Applicant will comply with state law regarding impacts to ground water as <br />more particularly described in the September 15, 2005 "Response to Reclamation <br />Permit Application Consideration" from the Office of the State Engineer to the <br />Division of Minerals and Geology and the conditions contained therein. A copy <br />of the "Response to Reclamation Permit Application Consideration" is attached <br />hereto as Exhibit A. <br />3.
