j ~ D RAFT ro~ai <br />Subject To Board pp <br />Minutes, July 25, 1990 <br />PAGE 11 <br />In response to a question from the Board, the Director stated that the <br />Division could not make a recommendation regarding the proposal <br />presented by the operator today, as the geotechnical information was <br />not submitted to the Division until today. <br />It was MOVED that the Board order a cease and desist order to be stayed <br />until October 10, 1990, provided that all of the items in the original <br />Board Order are complied with by that time, except for the planting of <br />trees and revegetation. The cease and desist order will be further <br />stayed until November 1, 1990, provided that the revegetation is <br />accomplished by that time; and it will be further stayed until May 1, <br />1991, provided that the remaining planting of trees is accomplished by <br />that time. SECONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, Cooley, <br />O'Connor, Jouflas, Danielson and Entz). <br />It was MOYED that the Board, after finding a violation of the <br />previously issued Board Order, reinstate the previously suspended <br />b2 ,150 civil penalty to be paid within 30 days. SECONDED AND PASSED <br />UNANIMOUSLY (Kraeger-Rovey, Cooley, O'Connor, Jouflas, Danielson and <br />Entz ). <br />At the operator's request, the issue of the culvert (HR-6) was <br />discussed briefly. Staff recommended that a 36-inch culvert be <br />installed to handle the 25-year, 24-hour storm event. <br />Ms. Tammy Akers, representing the Cedar Heights Lenders, and Mr. <br />Richard Wray, a professional engineer, briefly discussed the issue of <br />the HR-6 culvert. They stated that the Cedar Heights Lenders are <br />working toward a resolution of the culvert issue with the operator. <br />The operator is responsible for maintaining the quarry access road and <br />the roadside ditches. Mr. Wray recommended that the culvert installed <br />be sized to accommodate the historic flows of the area. Ms. Akers and <br />Mr Wray answered questions from the Board. <br />21.
