Specific regulatorv subsections for which waiver request is <br />being filed. <br />2.2 GROUND WATER MONITORING program as provided in Appendix B. <br />The draft document issued on October 23 does not require <br />ground water monitoring. It appears to leaves this <br />determination up to individual site review and approval. <br />Regardless, since this document is only a draft that has not <br />been adopted, a waiver is probably necessary to operate an <br />inert fill site of this size and duration without ground water <br />monitoring. <br />2.6.2 Post Closure Groundwater Monitoring Period. <br />3.6.1 (31 Post Closure Groundwater Monitoring Requirement. <br />Note: The above are the only references in the Solid <br />Waste Regulations that I found requiring <br />groundwater monitoring during both the operational <br />and post-closure period of a site's life. If there <br />are other sections where these requirements are <br />mentioned that also need to be waived, then this <br />request includes other sections that aren't <br />specifically referenced. <br />Ii. Alternative Requirements or Performance Standards <br />1. "Clearly defining the type of fill." This has been done <br />and any proposed changes will receive prior CDE and Adams <br />County approval. <br />2. "Insuring that the one type of waste that possibly could <br />impact groundwater, concrete not hardened for at least 60 <br />days, will be carefully screened and set aside for at <br />least 60 days out of contact with groundwater." This is <br />part of the proposed performance standards. <br />3. "Insuring that access to the site is completely <br />restricted to prevent any unauthorized dumping." This is <br />accomplished by the site being entirely fenced with a <br />gate that is locked during non-operating hours. <br />4. "Insuring that the site is operated by companies that <br />have the expertise to inspect and insure the waste stream <br />guidelines are followed." This is accomplished by <br />limiting the operation of the site to either the present <br />operator (Cooley), the owner (Colorado Sand and Gravel), <br />or by a future owner under contract to the owner who will <br />notify both CDH and Adams County of any change in <br />operator, and receive any prior approval of any change of <br />operations. <br />
