(b) Dfspoaitfon of surface. The right to lease, sell, or otherwise <br />dispose of the surface of the leased lands under existing law or lava here- <br />. •f ter enacted, insofar as said surface is not necessary for the use of the <br />lessee in the extraction •nd removal of the leased depocits therein, or to <br />dispose of any surface resource in such isndc which will not unreasonably <br />isRerfere with operations under this lease. <br />(e) Monopoly and fair Dtiees. The full paver and authority to promulgate <br />and enforce •11 orders and regulations issued under the provisions of Sections <br />30 and 32 of the Act, ais amended, necessary to insure the sale of the production <br />of the leased lands to the United States and to the public at reasonable prices, <br />to prevent monopoly, •m] to safeguard the public welfare. <br />(d) Renewal terms. The right reasonably to fix rental's and royalties <br />payable hereunder and other terms and conditions at the end of 20 years from <br />the date hereof and thereafter at the end of each succeeding 10-year period <br />during the con[inusnce of this lease unless otherwise provided by law at the <br />time of the expiration of any such period. Unless the lessee files objections <br />to the proposed terms or • relinquishment of the lesse within 30 days after <br />receipt of the notice o1` proposed terms for a 10-year period, he will be deemed <br />to have agreed to such terms and to the renewal of the lease. <br />(e) Waiver of conditions. The right to waive any breach of the conditions <br />contained herein, except: such conditions as are required by the Act, as emended, <br />but any such waiver aha].1 extend only to the particular breach as waived and <br />shall not limit the rights of the lessor with respect to any future breach; <br />nor shell the waiver of a particular cause of forfeiture prevent cancellation <br />• of this lease for any other cause, or for the same cause occurring at another <br />time. <br />Sec. 4. Relinquishment of ]ease. Upon a satisfactory showing of compliance <br />with the applicable regulations and that the public interest will not be im- <br />paired, the lessee may surrender the entire lease or any legal subdivision <br />thereof. A relinquishment must be filed, in duplicate, in the proper Land <br />Office. Upon its acceptance it shall be effective as of the date it is <br />filed, subject to the continued obligation of the lessee and his surety, <br />in accordance with the applicable regulations and the terms and conditions <br />hereof, (1) to make payment of all accrued rentals and royalties; (2) to <br />provide for the preservation of any mines, underground development works, <br />other permanent improvements or other property, whether fixtures or <br />personalty, on the leased land; (3) to provide for the reclamation of lands <br />and waters affected by exploration or mining operations under this lease; <br />and (4) to comply with all the requirements of section 5 of this lease. <br />Set. 5. Protection of the environment, nonmineral resources, and improve- <br />ments. and reclamation of lands and waters. The lessee agrees: <br />(a) To the same extent as if the operations under this lease were surface <br />mining, to meet all requirements formulated in accordance with the regulations <br />in 43 CFR Part 23, for the preservation and protection of the environment--land, <br />(• ]1 <br />
