It is expressly understood and agreed that <br />the lessee shall not have aqy right to, sad shall not, burn or othervise use <br />• for 21ie1 or energy production purposes, ary oil shale situated in or under <br />the lands described in sec. 1(a) hereof. <br />: (c) The lr_ssee shale"!taus the right and privilege (1) to mine and <br />extract o11 shale or other material located above the Saline Zone for the <br />sole purpose of emplacing such shafts or other entries as are necessary and <br />are authorized by the Regional Mining Supervisor to gsin access to the leased <br />deposits for mining, extraction, and removal operations, and (2) to mine, <br />a extract and process by non-retorting methods, which sre chemical or mechanical <br />and do not require the use of hest, 25 G.P.T. Oil Shale intermingled with the <br />leased deposits, but only to the extent necessary for and as an incident to <br />the mining, extraction, processing, beneficiation and removal of the leased <br />deposits, and only sa long as in the opinion of the Regional Mining Supervisor, <br />there is no significe.nt extraction or removal of the 25 G.P.T. Oil Shale%and <br />the 25 G.P.T. 011 Shale is not by the mining, extraction, processing and <br />beneficiation rendered unfit or significantly lowered in quality for reporting <br />purposes. <br />(d) The lessee shall have the right and duty to store all 25 G.P.T. <br />Oil Shale which has been mined and all other oil shale which, after mining, <br />has, ns a result of processing or beneficiation, become 25 G.P.T. 011 Shale <br />as directed by the Regional Mining Supervisor for its protection and in <br />accordance with secs. 2(1) and 5 of this lease. Except ns otherwise provided <br />herein, or unless otherwise authorized in writing by the Regional Mining <br />Supervisor, the lessee shall, prior to disposition, process or beneficiate <br />• any leased deposits in mined materiel to extrnet sodium compounds therefrom <br />where that materiel contains oil shale averaging more than 10 gallons of <br />shale oil per ton of rock mined, but less than 25 gallons per ton, such average <br />to be determined by modified Fischer assays of that material; the aforesaid <br />processing or beneficiation to be performed in such n manner that the lessee <br />separates from the sodium compound material that quantity of contained organic <br />matter necessary to limit the shale oil content, if nr~y, to not more than an <br />average of 10 gallons per ton in the mnteriBl removed from the leased premises. <br />The lessee shall storey or dispose of, as determined and directed by the <br />Regional Mining Supervisor, residue and/or waste materials which have been <br />separated from the leased deposlts or products thereof during or as a result <br />of mining, extraction, processing, beneficiation, retorting or other operations <br />conducted under this lease, where the aforesaid storage or disposal is not <br />otherwise provided for or authorized in this sec. 1(d) or in sec. 1(e), for the <br />protection or disposal of such materials ns appropriate and in accordance with <br />secs. 2(1) and 5 of this lease. It is understood that the processed 25 G.P.T. <br />Oil Shale or other processed oil shale, and, upon the termination of this <br />lease, any sodium compounds intermingled therewith shall remain the sole <br />property of the lessor and shall to subject to disposition at nrLy time by the <br />lessor as provided in .sec. 3(a)(1) hereof or otherwise. <br />3 <br />.~ <br />
