Land Office Serial Number <br />COLD-0]18326 <br />UNITID STATES <br />• DEPARTMENT OF THE INTERIOR <br />BITRFAU OF LAND MANAGD+lENf <br />SC>DIIM LEASE <br />In consideration of the benefits conferred on each perty by the terms of this <br />contract, this lease it: entered into on ~~ ~ , 1971, by the United States <br />of America, hereinafter called'the lessor, acting through the Bureau of Lend <br />Management of the Department of the Interior, hereinafter called the Depart- <br />ment, and liolf Joint Venture, a 3oint venture consisting of Colorado Mineral <br />Land Corporation, n Delaware corporation, and Wolf Ridge Corporation, a <br />Colorado corporation, Yierei.nafter called the lessee, pursuant and sub3ect to <br />the terms and provisioc~s of the Mineral Leasing Act of February 25, 1920 (41 <br />Stat. 437), as amended (30 U.S.C. secs. 1B1-263), hereinafter referred to as <br />the Act, and to the terms, conditions, and requirements (1) of all regulations <br />promulgated by the Secretary of the Interior thereunder in existence upon the <br />effective date of this lease, specifically including but not limited to the <br />regulations in Title 43 CFR Parts 3500 and (to the same extent ns if the <br />operations under this lease were surface mining) 23 and Title 30 CFR Part <br />231, ell of which are incorporated herein,and, by reference, made a part <br />hereof; and (2) of ell regulations hereafter' promulgated thereunder, When not <br />inconsistent with arty express and specific provisions of this lease, ell of <br />which shall be, upon promulgation, incorporated herein and, by reference, <br />made s psrt hereof. <br />• Definitions. The follauing definitions shall be used in the interpretation <br />of this lease: <br />(a) "Oil shale" is a fine-grained sedimentary rock containing organic <br />matter which was derived chiefly from aquatic organisms or vary spores or <br />pollen grains, which is only slightly soluble in ordinary petrole~ solvents, <br />and of Which a large proportion is distillable into artificial petroleum. <br />This term is applicable to any argillaceous, carbonate, or siliceous sedi- <br />mentary rock which will yield oil upon destructive distillation. <br />(b} "Saline Zone" as used in this lease means the lower part of the <br />Farachute Creek Member of the Green River Formation in the Piceance Creek <br />Basin, the top of which zone is defined at any point by the characteristic <br />"?issolution surface," esnd the bottom of which is defined at any point by <br />tl~e horizon marker desi_r,nated as the "Blue Marker," which "Blue A:arker" <br />forms the approximate becse of the Parachute Creek Tlember; and <br />(c) "Leased deposits" means (1) all sodium compounds (and arty related <br />products thereof) in thc~ Saline Zone not intermingled with oil shale averaging <br />?5 gallons of shale oil or more per ton of rock mined (l~ereinsfter referred to <br />as "25 G.P.T. Oil Shale'°), such average to be determine3 monthly for each <br />calendar month by modified Fischer assays of the rock mined Dy lessee for <br />processing or beneficiat.ion by any method, and (2) all sodium compounds (sn3 say <br />• <br />
