Nelligan <br />Chief Executive Officer <br />Western Aggregates, Inc. <br />11728 Highway 93 <br />Boulder, CO 80303 <br />Dear Mr. Nelligan: <br />Per your request concerning whether we would permit the Mined Land <br />Reclamation Division staff inspect our operating agreement for terms of <br />specifying that LC Holdings, Inc. requires that the plant site remain intact <br />following termination of the lightweight aggregate project, we hereby inform <br />you that: we do not feel it appropriate to make the confidential agreements <br />available to the public. <br />However, we can provide this letter and state herein that LC Holdings, <br />Inc, does not want the plant site dismantled upon cessation of the aggregate <br />project. We have gone to great lengths to convice the Jefferson County <br />Commissioners of the value of keeping the options open for future use as a <br />cement production or lime production facility or some other rotary kiln <br />related purpose. Jefferson County Commissioners approved it remaining intact <br />post aggregate production and we expect Western Aggregates, Inc, to continue <br />to work to ensure that the plant will remain intact. <br />Very truly yours, <br />~~~T~~~~ ~, . <br />Ryan T.
