Colorado River less than one (1) mile downstream from the operation. Between December 2000 <br />and May 2001, the Applicant and its representatives, including its attorneys, Balcomb & Green, <br />P.C. and engineers, Balaz & Associates, Inc., met with the staff and consultants of the City <br />including without limitation Bill Sappington, P.E., the City Public Works Director, Jeff <br />Simonson, P.E., Consulting Professional Engineer, and Loyal E. Leavenworth, the City <br />Attorney. Through these meetings, the Applicant proposed methods to mitigate the impacts of <br />the mining operation. <br />4. On May 16, 2001, RFR amended its application with supplemental information <br />to address the City's concerns. The Supplemental Information consisted of the items listed on <br />Exhibit B, and the City deemed the application complete. <br />5. The City and the Applicant have entered into an Agreement, attached hereto as <br />Exhibit D (the "Agreement"), regarding the City's participation in the DMG Permit process, <br />and other permit proceedings, which Agreement sets forth measures the Applicant has agreed <br />to perform to mitigate the potential water quality and water quantity impacts to the City's <br />Colorado River water intake structure resulting from the proposed mining operation. <br />Applicant's performance of the terms and conditions of the Agreement, as well as Applicant's <br />compliance with all county, state and federal permits, are an express condition of this Watershed <br />District Permit ("Permit"). <br />6. For purposes of the Permit, the application and public record shall consist of the <br />watershed district permit application dated October 17, 2000 filed by RFR (with attachments <br />listed on Exhibit A), the May 16, 2001 supplemental information listed on Exhibit B, the DMG <br />Permit Application and Adequacy Review Documents, the Floodplain Study, all correspondence <br />or material submitted to the City, the City's Consulting Engineer or the City Attorney in <br />connection with the proposed activities, the Agreement as well as all representations, whether <br />oral or written, made by the RFR and/or its agents or employees as part of the application and <br />public hearing process. These items shall be collectively referred to herein as the "Application." <br />7. RFR also needs a special use permit from Garfield County for Industrial <br />Operations, a Construction Materials Regular (112) Operation Reclamation Permit from the State <br />of Colorado Division of Minerals and Geology and other county, state and federal approvals <br />prior to commencing gravel mining operation. All permits issued or to be issued by such <br />county, state and/or federal agencies aze incorporated herein by this reference. <br />FINDINGS OF FACT <br />8. The proposed activities are within the defined boundaries of the City's Watershed <br />District as defined in Section 10.05.020 of the RMC, specifically above and within five (5) miles <br />of the City's Colorado River municipal diversion structure.
