III IIIIIIIIIIIIIIII <br />999 <br />BEFORE THE CITY COUNCIL OF THE CITY OF RIFLE, COLORADO <br />CONCERNING THE APPLICATION FOR A WATERSHED DISTRICT PERMIT OF <br />ROARING FORK RESOURCES, INC. <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND APPROVAL OF WATERSHED <br />DISTRICT PERMIT NO. 1-Ol <br />1. On October 17, 2000, Roaring Fork Resources, Inc., whose address is 14156 <br />Highway 82, Carbondale, Colorado 81623 ("RFR" or the "Applicant"), applied to the Ciry of <br />Rifle (the "City") for a watershed district permit for a gravel mining operation known as the <br />Mamm Creek Sand and Gravel Pit along the Colorado River within the City's Watershed <br />District, The application was submitted pursuant to Ciry of Rifle Ordinance No. 22, Series of <br />1994, codified in Chapter 5 of Title 10 of the Rifle Municipal Code. The application consisted <br />of the items listed on Exhibit A, incorporated herein by this reference. Upon its initial review, <br />Ciry staff deemed the application incomplete. <br />2. - RFR simultaneously applied for a Construction Materials Regular (112) Operation <br />Reclamation Permit with the State of Colorado Division of Minerals and Geology by Permit <br />Application No. 2000-113 ("DhIG Permit Application"). The Mamm Creek project site totals <br />approximately 483 acres; however, in the initial mining operation subject to the DMG Permit <br />Application and this permit application, the Applicant intends to mine aggregates from five pits <br />on 308.36 of the total 483 acres. Actual mined area will total 174 acres. Through the DMG <br />Application process, three Adequacy Review Documents analyzing the impacts of the proposed <br />gravel mining operation were prepared by Tom Schreiner dated November 1, 2000, Alan <br />Sorenson dated November 16, 2000 and the Division of Wildlife dated November 5, 2000. The <br />DMG Permit Application and these Adequacy Review Documents also constitute part of the <br />public record in this watershed district permit proceeding. On December 12, 2000, the Ciry <br />submitted a Party Status Request Form to the DMG requesting party status in the DMG <br />Reclamation Permit process and incorporated the concerns outlined in the Adequacy Review <br />Documenu. <br />3. The City's Consulting Professional Engineer, Jeff Simonson, P.E. of Schmueser <br />Gordon Meyer, Inc, prepared a Floodplain Study and Report of the Colorado River from Rifle <br />to Mamm Creek dated February 20, 2001 ("Floodplain Study"), which study concluded that the <br />proposed gravel mining operation could impact the Ciry's water intake structure located on the <br />1 <br />I:\7D01 \ClimuWFl.EIR-3\(219)\Dacumems\W a¢,shcdPervti\.wpd <br />AuguF B. 7D01 <br />
