<br />~~ <br />2. Proper Maintenance: .Any strucrure or fill authorized shall be properly <br />maintained, including maintenance co ensure public safety. <br />3. Erosion ar:d Siltation Controls: :Appropriate erosion and siltation controls must <br />be used and maintained in etfective operattng condition during construction, and all exposed <br />soil and other fills, as well as anv work below the ordinary high water mark or high tide <br />line, tnust be permanently stabilized at the earliest practtcable dace. <br />4. Aquatic Ilje Movernents: No acttvity may substantially disnrpt the movement of <br />those species of aquatic life indigenous to the waterbody, including those species which <br />normally migrate through the area, unless the activity's primary purpose is to impound <br />water. <br />5. Equipment: I{eavy equipment working in wetlands must be placed on maa, or <br />other measures must be taken to minimize soli disturbance. <br />6. Regional and Case-by-Case Conditions: The activity must comply with any <br />regional conditions which may have been added by the Division Engineer (see 33 CFR <br />330.4(e)) and with any case-specific conditions added bv_ the Curps or by the State or [ribe <br />in its Section 40l water quality cerctfication. <br />7. old and Scenic Rivers: No activity may occur in a component of the National <br />Wild and Scentc River System: or in a river officially designated by Congress as a "study <br />river" for possible incltuion to the system, while the river is in an official study status; <br />uNess the appropriate Federal agency, with direct management responsibility for such river, <br />has determined in writing that the proposed activity will not adversely affect the Wild and <br />Scentc River dcsignat:on. ur study status. Information on Wild and Scenic Rivers may be <br />obtained from the appropriate Frderat land management agency in the area (e.g. National <br />Park Servtce. U.S. Forest Service. Bureau of Land Management. U.S. Fish and Wildlife <br />Servtce). <br />8. Tribal Rights: Vo acttvity or its operation may impair reserved tribal rights. <br />including, but not limited ta. reserved water rights and treaty fishing and hunting rights. <br />9 !Voter ~rrality Ccrrijicrurat: In certain states. an individual Secuon 4fll water <br />yuali[v cenificatton must be obtained or waived. IN C.1LII'ORNIA. CERTIrICAT1ON <br />lS REQUIRED. In Nevada. ccrttficatton is required in Truckee and Carson River <br />Drainages. (n Utah and Colorado, individual cetttftcation is NOT required (see 33 CFR <br />330.4(c)). <br />10. Coastal Zane 9fanar;cmcnr: In certain starts. an individual start coastal zone <br />management consistency concurrence must be ub[ained or waived (see Secuon 330.4(d)). <br />1. Endangered Specta•: (a) No activity is authorized under anv na[iomvide permit <br />which is likely to jeopardize the continued existence of a threatened or endangered specter <br />or a species proposed for such designation, as identified under the Federal Endangered <br />Species Act, or which is likely to destroy or adversely modify the critical habi[at of such <br />specter.
