A "utility line" is defined as. any pipe or pipeline for the transpottation of any <br />gaseous, liquid, liquefiable, ur slurry substance, for anv purpose, and any cable, line, ur <br />wire for the transmission for anv purpose of electrical energy, telephone and telegraph <br />messages, and radio and television communication. The term "utility line" does not include <br />activities which drain a water of the United States, such as drainage tile; however, it does <br />apply to pipes conveying drainage from another arcs. 11tis NWP authorizes mechanized <br />landclearing necessary for the installation of utility lines, including overhead utility lines, <br />provided the clearing area is ::ept to the minimum necessary and preconstruc[ion contours <br />are maintained. However, access roads, temporarv or permanent, or foundations associated <br />with overhead utility lines are no[ authorized by this nationwide pettrtit. Material resulting <br />from trench excavation may be temporarily sidecasc (up to three months) into waters of the <br />United States, provided that the material is no[ placed in such a manner that it is dis, e-sed <br />by currents ar other forces. 71ce District Engineer may extend the period of temporary side <br />casting up [0 180 days, where appropriate. The area of watets of the United Stales chat is <br />disturbed must be limited to the minimum necessary to construct the utility line. !n <br />wetlands, the top 6' to l2" of the trench should generally be backfilled with topsoil from the <br />trench. Excess tna[erial must be removed to upland area immediately upon completion of <br />construction. :1ny exposed slopes and streambanks must he stabilized immediately upon <br />completion of the utility line. Tlie utility line itself will require a Section l0 permit if in <br />navigable waters of the United Stales. (See 33 CFR part 32''). <br />NOTIFICATION: I'ite pettnittce must notify the District L-ngincer in accordance with the <br />"Notification" general condition if any of [he following criteria are met: <br />(a) Mechanized landclcaring in a forested wetland: <br />(b) r1 Section 10 permit is required for the utility lint: <br />(c) The utility line in waters of the United States exceeds S00 feet; or. <br />(d) The utility line is placed within a jurisdictional area (i.e., a water of the United <br />States). and it runs parallel to a streambed that is within that jurisdictional area. <br />A. (:E'.YERAL CONDITIONS: Tlie fallowing general conditions must be met in order for <br />any auu:t:rization by a nationwide pcttnit to be valid: <br />1. Navigation: Vo activity may cause more than a minimal adverse effect on <br />navigation. <br />
