Colorado Department of Public Heakh and Environment <br />Air PoNutlon Control DlWsbn <br />• Surface mining equipment almost always requires <br />an air pertnft. <br />When a permit is required, the APEN will become part of <br />the permit applicetlon package. <br />- The Pernik Procetts: <br />In Colorado, Construc6ort Permits are sued in two <br />plisses: Initial Approval and Final Approval. <br />An Initial Approval (IA) Permit allows the plantar <br />process equipment to be constructed and begin <br />operation. Th~ self- <br />ceAifirretlon process must be cornpMted within 160 days <br />(six months) of being issued an Mitlal Approval Permit. <br />After 1rf0 days, the APCD must finalize the permit or <br />determine to continue or revoke the penntt. <br />Certifying corttpliance with fire IA permit for a surface <br />mining site typically involves submitting a Final Approval <br />Sett Certincatbn Forth. This forth b avaUable through <br />the APCD and downfoadabie at: <br />vtmmv.cdahe.amte.co.uslaa/downloadfortns.aso <br />Certifying compliance with the IA permit for process <br />equipment typically involves submittktg a Final Approval <br />Self Certification Form and the required opacity test <br />results (i.e., either a 8-minute opacity reading a a 1-3 <br />hour opacity reading may be required depending on the <br />type and design rate of the equipment). The APCD can <br />assist you !n determining the opacity readkrga required <br />for your equipment. <br />'.fL`~.~ <br />House Blll 132Q - Rex/bilky for Crushers <br />and Screens <br />Owners ar operators of surface mining operetions are <br />typically required to obtain an IA permit for process <br />equipment prio- to operating fire equipment at the site. <br />However, Colorado House Sip 1326 provides some <br />flexibtilty for reporting and permitting crushers and <br />screens. Under House Btil 1328, the owner or operator <br />of a permided sand and grevel pR or crushed stone <br />quarry may bring a new crusher or screen (and the <br />engines that are integral to those crushers and screens) <br />onsite and begin operation of this equfpmerrt by <br />submitting an APEN to the APCO. In cases where you intend to return <br />temporary or rented equipment tirithin a fatty months, you <br />can avoid unnecessary penniltln9 tee by reQt+e~9 <br />that the APCD'holQ' the APEN unfft you remove the <br />equipment and submit a cenceltatlon to the APCD. <br />Applicable Fees <br />APEN Flung Fp: A ftiing fee of 5119.96 is required to <br />be rerbmilted wNh each APEN. <br />Annual Emission Fess: All sources requked to file <br />APENs must pay annunt air emissbn fees. The APCD <br />bills each source that ~ subject !b an APEN an annual <br />fee of 113.54 per ton of rxiteria pollutanffi emitted and <br />190.34 perton Bran-crtterta (hazardous air polutants) <br />emtted. Fees are not assessed for fugitlve duet <br />emissions. Invoices aro mailed in Marsh through June of <br />each year. Fees are subject to change by the <br />legislature on an annual basis. <br />Psrrrritting Fees: The APCD assesses a permitting fee <br />based on the amount of time it takes the APCD to <br />process the appiicatbn. The current processing fee is <br />559.98 per how.
