In accordance with your letter dated January 11, <br />1995, the decision date for the application has been extended to February <br />8, 1995 to afford you sufficient time to address these issues. <br />1. On the Pre-Mining and Mining Plan maps submitted with the January <br />11, 1995 adequacy response, Area 2A is delineated and is labelled <br />"AREA WHERE NO MINING SHALL OCCUR WITHOUT PRIOR UD&FCD APPROVAL". <br />The implication then exists that mining could occur with UD&FCD <br />approval (although the revised Mine Plan narrative does state mining <br />in this area will not take place until "any other relevant approvals <br />are obtained"). In order to ensure enforceable mining set-back <br />criteria discussed at the January 5, 1995 joint meeting between the <br />applicant, Division of Minerals and Geology (DMG), and Division of <br />Wildlife (DOW), please submit a Pre-Mining Map that clearly <br />delineates a non-mining area at the northwest corner of the <br />property. The non-mining area should include a minimum 250 foot <br />set-back from the ordinary high water line of the river, and should <br />extend from the boundary of cultivated land south of the sharp bend <br />in the river, to the boundary of cultivated land east of the bend in <br />the river. A statement should be included that the slurry wall and <br />any UD&FCD required river channel improvements will be installed <br />outside of the non-mining setback. <br />2. DMG recommends the following replacement wording for item 4 of the <br />revised reclamation plan narrative: <br />Ground cover vegetation will be established in the non-mining <br />set-back area in the northwest corner of the property <br />delineated on the Pre-Mining Map. The ground cover will be <br />established by placement of 6 inches of topsoil borrowed from <br />
