SURFACE RIG 5 OF LBSS$B <br />Lessee tray remove and dispose of all brush, trees, undergrowth, and other vegetation <br />from the Leased Property as may be reasonably necessary to explore for maurisls or to locate <br />roads, pits, quarries, stockpile areas, and/or buildings and equipment. <br />Lessee may erect moveable plant or plants on the Leased Property, if it should so desire, <br />to process materials. Lessee may also erect moveable or temporary buildings and install <br />machinery and equipment as maybe useful in connection with its Gravel Miaillg Operation. <br />VII. PROTECTION' OP' PREMISES <br />Lessee agrees to maintain at its cost existing fencing and gates. Gates will. be kept locked <br />during the hours of darkness and at all times when the Leased Property is not occupied by <br />Lessee's personnel <br />VIII. PAYMENT OF TAXES <br />Lessor agrees to pay all real estate taxes levied against the Leased Property before they <br />• become delinquent. In the event that the Lessor fails to pay the taxes, Lessee may, at its option, <br />pay any taxes and assessments that may be Ie~zed against the Leased property and deduct the <br />amount of tax payments, together with any penalties ar interest required to be paid, from any <br />amount due ar to become due to Lessor, <br />IX. REMOVAL OF IlyyiPROVENIBNTS AND EOUIPIvIEN'T <br />All improvements and equipment placed on the Leased Property by Lessee, except <br />frnces, gates, and cattle guards, shall remain the property of Lessee, and Lessee shall have the <br />right to remove the property prior to the expiration of this Lease so long as no monetary defaults <br />exist. On terrination of this Lease for any cause other than nonpayment of royalties or annual <br />m;nimuma hereunder, Lessee shall have the right to remove all such improvements and <br />equipment within oae hundred twenty (120) days from the date of termination except fences, <br />gates, and cattle guards. If the Leese is terminated for the non-payment of royalties or annual <br />minimums, upon payment by Lessee of any delinquent royalties or annual nainimtutts, Lessee <br />shall then have the right to remove all such improvements and equipment within sixty (60) days <br />thereafter, except fences, gates, and castle guards. Lesscc shall have one hundred twenty (12D) <br />days fromthc date of'ttnnination to remove any materials mined andprocessedbutnotremoved <br />on the date of termination subject to payment of royalties as provided in this Lease. <br />• <br />
