<br />RIDER TO MINING PERMIT <br />Permit Daze: lanruary Il, 1999 <br />Permit No: M-97-054 <br />The following additioWal stipulations and cortditians form an integral pact of the foregoing permit: <br />Stipulation No. Description <br />1. The Applicant shall submit a fiaat[cial warranty in the amount of 3276,700..00 <br />2. The operator will monitor two of the 15 individual or multiple spring source's that were mapped <br />by Azurite, bc., and located oW the rwrtit side of the Arkareas River on a semi-annual basis for <br />flow rate fluctuations and include the results of the monitoring with its Annual Report. If a <br />significant Flow rate decrease is observed which is above 21196 and not associated with a dry <br />season far the region, the operator shall promptly investigate the cause of the drop in flow rate <br />and promptly submit a report of it's fudings ro the Division. In addition, the Operazar shall <br />rruazsure the two monitoring wells located along the southern bw~ary of the permit area for <br />static water elevation on a semi~Wnnual basis and include those ttteasurentems in its Annual <br />Report. The op[rrtar shall promptly investigate any significant drop in static rvazer elevation that <br />is not associated wi0[ seasond co~itions and protr[ptiy submit a report of the results of the <br />investigation to the Division. <br />To address t)te concerns about pxeotial. comamiuatioW from chemical m:thods used by the <br />operator for wend control, the Operazor shall cotduct water quality [eats along with the <br />monitorirng of dte wells sad aprirtga provided for in this condition. The Division of Mirerals and <br />Geology will develop for the operator a list of the water quality pazarneters tlhe operator will he <br />required ro test. The pazameters will be limited to those associated with the operator's ttse of <br />herbicides in implememtivg it's noxious weed (leafy spurge) rttanagetnem pLtn. <br />3. The berrtorite clay liner of the fuel srorage area will be compxted ro a permeability of i x lOfi. <br />Prior ro placement of the gravel liner, the operator shall submit for the Division's approval the <br />results of four (4) evenly pemxabihry tests of the liner. The tests shall be performed by <br />a certified geotechrical engintxr. <br />4. Tht operator shatl report any significara fuel spills wtside the containment area to the Division <br />within 24 hours of the spill. The operator shall send ro the Division, as sacra as practieable, a <br />report on dse mitigation of any potential pollution of the ground water system due to the spill. <br />3. in the same [Wanner as provided for the testing of quantity aWd quality testing of dte two (2) <br />springs defined in CorditioW No. 1. the operator shall test the Marl; N. AM Jacque <br />Brown/Robert std Susan Steers spring located east of County Road 157 on a bi-armual basis, <br />provided the owners and users of the spring provide sufficiem reasonable t[ccess to allow the <br />operator to comduct the sampling raxessary for the water quality test. <br />
