Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />As you know, the applicant is required to provide a notarized agreement between <br />the applicant and the persons having an interest in structures within 200 feet of the <br />affected land or provide an engineering evaluation that demonstrates that such <br />structure shall not be damaged by activities occurring at the mining operation. <br />These must be provided prior to approval of an application and issuance of a <br />permit. If these documents cannot be provided, all maps must be revised to show <br />that affected land is at least 200 feet away from any permanent man-made <br />structure. <br />As stated, the decision date for this application was January 2, 2007, however, per your <br />discussion with Tony Waldron; the decision date will be extended until Mazch 2, 2007. <br />If you have any questions you may call me at 303-866-3927. <br />Surely, ,~ <br />David A.
